If a Bhikshu accuses a Bhikshuni of being a female hermaphrodite's discharge, or a Bhikshuni accuses a Bhikshu of being a male hermaphrodite's discharge, it is a Sanghavasesa; if it is otherwise, it is a Nissaggiya Pacittiya. This is indeed a Sanghavasesa, because it is explained in the root commentary, and because of accusing with the name of defeat. Some say this. If so, it contradicts "the truth of the matter itself" and "the thought is that itself," and it contradicts the statement that "the defeated are particularly indulgent" as a branch of meaning, and it would also lead to "not wearing a round lower garment will lead to defeat." Having refuted this, one's own view is that this is attributing a minor offense to a Sanghavasesa, because the offense of accusing is a Sanghavasesa, and the heaviest Sanghavasesa is division and bloodshed, because there is no accusation heavier than a minor offense, and in the inquiry it is said that accusing a Sanghavasesa is a minor offense. Otherwise, accusing of defeat would also lead to defeat, which would be too much. Some say this. Some say that accusing of a Sanghavasesa does not become a Sanghavasesa, but is disparaged in the Mahavagga. In this way, engaging in non-disclosure, accusing with a defeated Sanghavasesa, results in a remaining Sanghavasesa. Saying this contradicts the statement that "accusing of bloodshed is a minor offense." The Anantariya of bloodshed is a Sanghavasesa belonging to the defeat of killing. The Anantariya of dividing the Sangha is said to be a Sanghavasesa belonging to division, which needs to be examined. Regarding "after thinking," the commentary says, "Speaking after thinking. If one makes a biased statement in that way, it is a minor offense." Here, the word "etc." is to indicate the meaning of other ways. In the inquiry it is said, "The Bhikshu rises from the disclosure and says, 'I spoke after thinking,'" just like "it will become a minor offense from everyone." The intention of what was said should be sought. The commentary says, "Even slightly, those ways should be known, that is, I saw so-and-so Bhikshuni engaging in impure conduct with a male hermaphrodite, practicing the Dharma of intercourse." And so on. Thus, if one accuses a Bhikshu, it is associated with a female hermaphrodite. Therefore, this is a groundless way of accusing, that is, a Bhikshu and so-and-so Bhikshuni.

If one knows how to apply the accusation in this way, one will easily understand how the previous debates were conducted. I think that what the speaker thinks, the listener must also understand in the same way. Therefore, it is necessary to add that the object of sexual intercourse that produces residue is not like male and female hermaphrodites. Among the transgressions of precepts, there are three types. The grave offense that pertains to the present situation is residing together with others' retinue, etc. To lead them over is to place them on one's own side. Doing so is a grave offense. Separating actions and behaviors from this is to intervene in a divisive manner. That's what they say. Expelling someone without parental permission is a misdeed, residing together, and allowing a servant who stole from another to flee to one's place is a defeat. In the Mother's Differentiation, expelling relatives without the family's permission is said to be a residue, and the grave offenses mentioned here, etc., are the same in that they place those under others' control on their own side, but how are the degrees of transgression different? Except for the second case, there is no defeat for the others, because there is no intention to steal. The two cases of expulsion are without transgression, because they are involved in actions that harm others. Even so, it does not become a grave offense due to division, because it is involved with the intention of wanting to liberate from the ocean of household life, and not involved in separating actions and behaviors. The severity of the transgression depends on the degree of harm to the object, as the former ones said. There are three common characteristics, among which there are five common dharmas established: among the ten precept transgressions, there is the commonality of resembling precepts, the similarity of having five prohibitions each, the prohibition, the same number of transgressions, and the commonality of the two causes that do the same thing together, taking and prohibiting. The first is that if there is prohibition such as admonishment, the transgression is complete, and if not, it seems incomplete. The second is that the prohibition of an ordinary friend is admonishment, and although it is not a real prohibition, it is its cause.
