如果具备所有条件,那人就犯了重罪,即使杀了别人也是重罪。如果想杀人并采取行动但没有杀死,也是重罪。如果具备所有条件,那就是堕罪。四种堕罪中,断命的堕罪就结束了。关于不予而取的开端是,世尊住在王舍城光明的园林迦兰陀竹园时。当时,以前做陶匠后来出家的比丘名叫财护,在王舍城的寺院里搭了个茅棚居住。后来,财护在王舍城乞食的时候,王舍城的牧童和樵夫们拆毁了他的茅棚,把草和木头各自拿走了。像这样多次拆毁之后,陶匠财护心想,这样到处骚扰,搭建茅棚也会严重扰乱修行,成为证悟的障碍,不如我按照以前的地方,做一个土坯房,粉刷一下住在里面吧。他这样想着,就打了房子的地基,砌好墙,粉刷了一下,做了一个非常漂亮的,像红色而闪耀的吉瓦花一样的房子,住在里面。其他时候,世尊带着比丘眷属游化,看到了房子,问道是谁的?他们回答说是比丘财护的。世尊说,因为这样外道们会嘲笑,把房子拆了吧。比丘们就拆了房子。之后,财护又想,我和王舍城的护林官关系好,不如做一个木头房子吧。他这样想着,对护林官说,请给我一些神赐的木头吧。护林官回答说,如果神赐予了,尊者您就随意取用吧。于是,他砍伐了很多王舍城修缮破旧房屋的木头,劈开后拿走了,被守城官看见了,就告诉了国王阿阇世。把有理由的人叫来,(护城官对财护说)比丘你擅自拿走不予之物,国王赐予了我。(财护说)以前父王给您加冕为国王的时候,我的国家以善良闻名,所以比丘和婆罗门们

The beginning of taking what is not given is that the Blessed One was dwelling in the Bamboo Grove of Kalanda, the Garden of Light in the city of Rajagriha. At that time, a monk named Dhanamitra, who had previously been a potter and later ordained, lived in a hut in the monastery of Rajagriha. Later, when Dhanamitra was begging for alms in Rajagriha, the herdsmen and woodcutters of Rajagriha demolished his hut and took the grass and wood away. After being demolished many times like this, the potter Dhanamitra thought, "Being harassed everywhere like this, building a hut will also seriously disturb my practice and become an obstacle to enlightenment. It would be better if I followed the previous place and made an adobe house, whitewashed it, and lived in it." Thinking this, he laid the foundation of the house, built the walls, whitewashed it, and made a very beautiful house, red and shining like a Jivaka flower, and lived in it. At another time, the Blessed One was traveling with his retinue of monks and saw the house and asked whose it was. They replied that it belonged to the monk Dhanamitra. The Blessed One said, "Because of this, the heretics will mock us, tear down the house." The monks tore down the house. After that, Dhanamitra thought again, "I am friendly with the forest ranger of Rajagriha, I should make a wooden house." Thinking this, he said to the forest ranger, "Please give me some wood given by the gods." The forest ranger replied, "If the gods have given it, Venerable, please take whatever you need." So, he cut down many pieces of wood that were used to repair old houses in Rajagriha, split them, and took them away. The city guard saw this and told King Ajatashatru. He summoned the person with a reason, (the city guard said to Dhanamitra) "Monk, you have taken what was not given without permission, the king has given it to me." (Dhanamitra said) "When the former king crowned you as king, my country was known for its goodness, so the monks and Brahmins"

The king said: This applies to ownerless things, not to owned things. Someone reported: What power do you, the king, have over ownerless things? The king became furious and rebuked: A bhikkhu who takes things without permission should be killed, and you must not do this again! After saying this, he sent him away. Later, the bhikkhus reported this matter to the Blessed One. The Blessed One said to Ananda: Ananda, go and ask the king's city officials and caravan leaders how much toll they take that would be punished by death or expulsion from the country. Ananda did as he was told. They replied: Stealing five mashakas or more than five mashakas of toll would be punished by death or expulsion from the country. Ananda reported this matter to the Blessed One. The Blessed One summoned the bhikkhus with property, scolded them in various ways, and established the precepts. A novice, whether himself or others, with a stealing mind, by force or deception, without confusion, from another person's place, steals about five mashakas, or from his own place, steals a quarter of a karshapana, stealing these will break the precepts. A novice refers to someone who abides by the monastic precepts. The same goes for myself, if I steal with a stealing mind, by force or deception, I will break the precepts. Like this, if with a stealing mind and by force or deception, a quarter of a karshapana is stolen, and the value is sufficient, it will be judged as a defeat. If there is no stealing mind, one will commit a sin of confession. If others steal by force or deception, the precepts will be broken, but not by oneself personally stealing, but by asking a bhikkhu friend to steal, and then he steals by force or deception. If we divide the spoils and the value is sufficient, it will be judged as a defeat. If the value is not sufficient, one will commit a gross sin. If one takes a share of the spoils each time one steals, and the value is not sufficient, one will commit a gross sin. The so-called "without confusion from another person's place," confusion is ignorance and not remembering, and without confusion is the mind naturally...
