名为“若禽兽”所说即是。森林起火等焚烧,杀害鹿等动物时,那些动物的所有者是谁呢?因此,森林起火等抓住(动物)的缘故,对于鹿和鸟以及毒蛇设置陷阱的那些,不是设置陷阱者就不是所有者。如是说,猎人等陷阱所有者以森林起火等的方法抓住的缘故,鹿等设置陷阱后逃脱的那些,鹿等设置陷阱的那些,只有设置陷阱者才是所有者,不是设置陷阱者就不是所有者。因此,不是设置陷阱者如果以盗心拿取,就会因此成为盗贼。提到鹿等是举例,家畜和人设置陷阱,有所有者的和没有所有者的,如果从陷阱中取出,就会成为盗贼,即使有其他所有者,像这样在那时只有设置陷阱者才是所有者。对于所有者不确定的物品,如何安立堕罪呢?因此,对于没有区分的,就从根本上安立(堕罪)。如是说,区分就是完全确定。没有区分就是完全不确定,这个是有所有者的还是没有所有者的,这样没有区分,对于宝藏等任何物品,偷盗时就从根本的性质上安立堕罪,而不是从认识上安立。如果是有所有者的,那么从根本上,如果分支完整,就会失败。如果是没有所有者的,那么就安立为粗罪。如果说要计算价值,由于地点和时间不同,物品的价值也显现为不同,那么什么时候安立价值呢?因此,价值是根据偷盗的地点和时间来定的。如是说,与“安立”相连。价值是根据偷盗的地点是什么,时间是什么来安立的。这样显示说,在哪个地方偷盗,在哪个时间偷盗,就要与那个地方和那个时间的物品的价值相结合,以此来安立堕罪。

English

That which is said as "If birds and beasts" is that. When forests are burned and deer and other animals are killed, who is the owner of those animals? Therefore, because the forest fire and others have caught (the animals), for those who have set traps for deer, birds, poisonous snakes, the one who has not set the trap is not the owner. Thus it is said, because the trap owners such as hunters have caught them by means of forest fires and so on, those deer and others who have been trapped and escaped, those deer and others who have been trapped, only the one who has set the trap is the owner, and the one who has not set the trap is not the owner. Therefore, if someone who has not set a trap takes it with a thieving mind, he will become a thief. Mentioning deer and so on is an example, livestock and people who have been trapped, those who have owners and those who do not, if they are taken out of the trap, they will become thieves, even if there are other owners, like this, at that time only the one who set the trap is the owner. How should a transgression be established for an object whose owner is uncertain? Therefore, for that which is not distinguished, it is established from the basis. Thus it is said, to distinguish is to be completely certain. Not to distinguish is to be completely uncertain, whether this has an owner or not, not distinguishing like this, for any object such as treasure, when stealing, the transgression is established from the nature of the basis, not from the perception. If it has an owner, then from the basis, if the branches are complete, it will be defeated. If it does not have an owner, then it is established as a gross offense. If it is said that the value should be calculated, since the value of objects appears to be different due to different places and times, then when should the value be established? Therefore, the value is determined by the place and time of the theft. Thus it is said, connected to "establish". The value is determined by what is the place of the theft and what is the time. This shows that in whatever place the theft was committed, and at whatever time the theft was committed, the value of the object at that place and at that time should be combined, and the transgression should be established accordingly.

如果说“是偷盗或教唆偷盗的人”,如果无意中偷了,该如何处理?因此,说了“无意中没有堕落”。凡是无意中因迷惑而偷盗的,就没有堕落。就像近侍阿难请问的那样:尊者,如果比丘以偷盗心偷了法衣的撑杆,法衣也连带着被偷了,会犯什么罪?应该计算法衣撑杆的价值。法衣的价值没有说要计算,因为是无意的。如果说“以偷盗心”,如果以其他心会怎么样?因此,应该让别人知道,以自己、假装和心怀叵测的心拿取,就没有堕落。自己的心和假装的心,以及心怀叵测的心,就是自己、假装和心怀叵测的心。以自己的心等等,在没有偷盗心的情况下让别人知道而拿取,就没有堕落。有些人说,这里“没有偷盗心”这句话没有必要说,因为对于自己的东西不可能有偷盗心。不是这样的,对于自己的东西也完全可能有偷盗心。在什么时候,把自己的东西交给别人,后来以偷盗心想方设法也要让他偿还债务,从而进行偷盗,因为有这种情况,所以要特别说明“没有偷盗心”。就像比丘以偷盗心拿取自己的钵和法衣也会犯重罪一样,所以说比丘应该以自己、假装和心怀叵测的心拿取。如果说“如所说,这是我委托的”,应该让别人知道。经师说,为什么要说“让别人知道”呢?因为经典中也说“应该让别人知道”。“没有偷盗心,其他人也一样”,意思是说,除了那三种情况之外,没有偷盗心的其他人拿取也没有罪过。其他人怎么会没有罪过呢?近侍阿难请问说,比丘对比丘这样说:你

If it is said, "It is the one who steals or instigates stealing," if one steals unintentionally, how should it be treated? Therefore, it is said, "There is no downfall in unintentionality." There is no downfall for whatever is stolen unintentionally due to confusion. As Ananda asked: Venerable, if a monk steals the support of a Dharma robe with a stealing mind, and the Dharma robe is also stolen along with it, what offense is committed? The value of the Dharma robe support should be calculated. The value of the Dharma robe is not said to be calculated, because it was unintentional. If it is said, "With a stealing mind," what if it is with another mind? Therefore, it should be made known to others, and taking with one's own, feigned, and scheming minds, there is no downfall. One's own mind, a feigned mind, and a scheming mind are one's own, feigned, and scheming minds. Taking with one's own mind, etc., without a stealing mind, after making it known to others, there is no downfall. Some say that here, the phrase "without a stealing mind" is unnecessary, because it is impossible to have a stealing mind for one's own property. It is not so, it is entirely possible to have a stealing mind even for one's own property. When one entrusts one's own property to another, and later, with a stealing mind, tries by all means to make him repay the debt, thereby stealing, because there is such a case, it is necessary to specifically state "without a stealing mind." Just as a monk would commit a grave offense if he took his own bowl and Dharma robe with a stealing mind, it is said that a monk should take with his own, feigned, and scheming minds. If it is said, "As said, this is what I entrusted," it should be made known to others. The Sutra Master says, why is it said, "Make it known to others"? Because the scriptures also say, "It should be made known to others." "Without a stealing mind, others also," means that apart from those three cases, there is no offense if others take without a stealing mind. How can others be without offense?
