不是这样的,以及,这是律,这不是律,以及,这是罪,这不是罪,以及,这是重的,这是轻的,以及,这是有剩余的,这不是有剩余的,以及,这应当制止,这应当忏悔,以及,这是违越律的,以及,这是说了恶语的,以及,这是善,这不是善,以及,对于不给予教证有三种情况,即认为是善,认为是恶,以及两者都不认为,也依次对应。凡是争执的,那就是诤论,分为四种情况对应。第一种情况仅仅是说不一致。第二种情况是与此不同。第三种情况是两者一起。第四种情况是不包括这些。从不给予教证而产生的诤论的争论点是,说了不应该说的话,因为说了不好的话而不给予教证和念诵,因为阻止了给予教证等,所以称为不给予教证的诤论。那又是什么样的呢?例如,比丘尼朋友因为巨富之子被丈夫打败而指责并谈论,对此,其他比丘也谈论此事,并且因为高兴而羞愧地说没有做。又如,沙石比丘发疯后做了任何事,清醒后,其他比丘说出那个罪过,然后说我不记得了,于是比丘们阻止了对此给予教证,不给予教证,像这样的情况等,称为从不给予教证而产生诤论。如果从罪过产生诤论,那么就成为五种堕罪的争论点,从而产生诤论。罪过的根本是,从身体、语言、意三者全部具备而产生的也有,从具备两者而产生的也有,从三者各自单独产生也有。其中,仅仅从身体产生的是,例如,没有受近圆戒的人,以及,睡在一个房间里,没有出去或者认为出去了而睡,以及,睡在自己的家里,后来女人来了睡了,或者,自己睡着了,被别人放在床或大座上,这就像是身

not so, and, this is the Vinaya, this is not the Vinaya, and, this is an offense, this is not an offense, and, this is heavy, this is light, and, this is remaining, this is not remaining, and, this should be restrained, this should be confessed, and, this is transgressing the Vinaya, and, this is having spoken badly, and, this is good and this is not good, and, there are three ways of not giving testimony: considering it good, considering it bad, and not considering either, which are also applied in sequence. Whatever is conflicting, that is the dispute, applied in four ways. The first way is merely speaking discordantly. The second is different from that. The third is both together. The fourth is excluding those. The basis of dispute from not giving testimony is: speaking what is not appropriate to speak. Because of speaking badly, not giving testimony and recitation, because of preventing the giving of testimony and so on, it is called the dispute of not giving testimony. What is it like? For example, a Bhikshuni friend accuses and talks about the son of a wealthy man being defeated by her husband, and other Bhikshus also talk about it, and because of being pleased, she says with shame that she did not do it. Also, like a sandy Bhikshu who goes mad and does anything, and after recovering, other Bhikshus say that sin, and then says, "I don't remember," and then the Bhikshus prevent giving testimony about it, not giving testimony. Such kinds of situations are called disputes arising from not giving testimony. If a dispute arises from an offense, then it becomes the point of contention from the five classes of offenses, thereby causing dispute. The root of offense is that it arises from the complete possession of body, speech, and mind, and it also arises from the possession of two, and it also arises from each of the three individually. Among them, what arises solely from the body is, for example, a person who has not received full ordination, and sleeping in the same room, not going out or thinking of going out and sleeping, and sleeping in one's own house, and later a woman comes and sleeps, or, one falls asleep and is placed on a bed or large seat by another, this is like the body.

仅仅从地而生。也有仅仅从语而生的,比如妇女边走路边思索,说了超过五六句或七句的法,就是仅仅从语而生的。仅仅从心而生,不可能最终改变。那是什么原因呢?因为心在一瞬间进入,又在一瞬间返回,心是微小的部分,所以犯了应该约束的过错。这里没有说。身体和心两种产生过错,比如杀生和饮酒,就是身体和心两种产生过错,但不说话。也有语和心两种的,比如边思索边说了超过五句或七句,对妇女说法,就是语和心两种产生的。身体、心和语三种都产生过错的也有,比如杀生,心也思索,身体也行动,口里也说杀,还说死了好。总的来说,从那样的事发生争论,从上位者的身语意三门那样产生,内部争吵不和,从而发生争论。还有,没有确定罪过而发生争论,比如乞讨的比丘像我这样,因为发生了罪过,其他喜欢利益他人的比丘就说让他堕落吧。回答说没有看见,心里不高兴而否认。像鹿敌之子黑色的那样,住在舍卫城。又因为如法,受到离车子们的恭敬,广严城的比丘们就生起嫉妒。寻找对他进行摈弃的借口,有一次大家一起洗澡的时候,他脱下内衣放在那里。和其他人的内衣混淆了,穿错了,就寻找借口。对他也没有说,他也没有找机会,就暗中做了摈弃的业,他也不高兴,就到舍卫城世尊那里去。世尊呵斥了他,详细地禀告之后,别人也没有说,自己也没有找机会,没有公开就做了摈弃的业,是不算的,这样说了之后就摈弃了。手比丘如果别人说了就承认了。之后做了应该摈弃的业又否认了。

It arises solely from the earth. There are also those that arise solely from speech. For example, when a woman, while walking and contemplating, speaks Dharma exceeding five, six, or seven sentences, that arises solely from speech. It is impossible for something arising solely from the mind to ultimately change. Why is that? Because the mind enters in an instant and returns in an instant. The mind is a minute part, so it commits the fault of needing to be restrained. This is not mentioned here. Faults arising from both body and mind are like killing and drinking alcohol. These are faults arising from both body and mind, but without speech. There are also those arising from both speech and mind. For example, while contemplating, speaking Dharma exceeding five or seven sentences to a woman arises from both speech and mind. There are also faults arising from all three: body, mind, and speech. For example, like killing, the mind contemplates it, the body acts on it, and the mouth says "kill," and even says "it is good to die." Generally, disputes arise from such things. Disputes arise from internal strife and discord caused by the actions of superiors through their body, speech, and mind. Furthermore, disputes arise from unresolved faults. For example, if a begging monk is like me and commits a fault, other monks who are fond of benefiting others might say, "Let him fall!" He replies, "I did not see it," and denies it with displeasure. Like the black son of the deer enemy, he resided in Shravasti. Because he was virtuous, he was revered by the Licchavis, and the monks of Vaishali became jealous. They sought a reason to expel him. Once, when everyone was bathing together, he took off his inner garment and left it there. He mistook it for someone else's garment and put it on, so they sought a reason to accuse him. They did not speak to him about it, and he did not find an opportunity, so they secretly performed the act of expulsion. He was displeased and went to the Blessed One in Shravasti. The Blessed One rebuked him, and after he reported the details, the Blessed One said, "If others have not spoken about it, and you have not found an opportunity, and the act of expulsion was not done openly, then it is not valid," and he expelled them. The monk with hands confessed when others spoke of it. After doing the act of expulsion, he denied it again.
