If a monk is accused of having committed a transgression and a dispute arises, it should be judged according to good and bad, and the words with merit should be taken as authoritative. If the merits of discipline are equal, then the words of one who has heard more should be adopted. If the amount of hearing is the same, then the words of one with fewer desires should be taken as authoritative. This is classified as a dispute arising from not pointing out a transgression. For those who are suitable to be tamed by non-intoxication, the method of taming by non-intoxication should be given. In Rajagriha, there were many monks who, due to the karma of previous lives, became intoxicated and committed many transgressions. Later, when they regained their memory, they were accused by others, saying, "You cannot be counted as monks." A monk named Bhikshu Tui said, "I forgot because I was drunk, I was powerless." The Buddha said, "If one does wrong unconsciously due to intoxication, there is no fault, consider it carefully." And other related matters. If a monk becomes intoxicated and loses his memory, and later, when he is sober, he is accused of having committed a transgression, then it should be investigated whether he committed it while intoxicated or after being sober, and then the situation should be taken into consideration. Combine his previous coarse and fine behaviors, as well as his honest and dishonest actions, and mediate. This is classified as a dispute arising from not pointing out a transgression. For those who are suitable to be given many yardsticks, many yardsticks should be given to tame them. In Shravasti, learning and mediation should be done by monks who are intelligent and clear. If the Sangha in the same area disagrees on Dharma and gains and a dispute arises, the Buddha will distribute yardsticks on Dharma and non-Dharma and instruct, "Take the one with more yardsticks as the standard." And other related matters. If two monks disagree and a dispute arises, learning and mediation should be done by monks who are intelligent and clear. If the Sangha in the same area cannot mediate, then the two disputing parties should be sent to other monasteries together with a Vinaya-holding monk. If those Sanghas also cannot mediate, then both parties should be recalled, and yardsticks on Dharma and non-Dharma should be distributed in the original Sangha, with the majority prevailing. If the number of yardsticks is the same, then one yardstick of the eight great persons should be added to the yardstick of the Dharma-holder to determine the truth. The yardstick of non-Dharma is wavering and not smeared with fragrant oil. This is classified as a dispute arising from disagreement.
