The agent here mainly refers to the person who, for his own use, thinks that there are sentient beings in the water, etc. This downfall is composed of five branches: using anything for oneself, and water, etc. that is with any sentient being belonging to the animal realm, and recognizing this, oneself and others using it, and how many sentient beings die. If these branches are incomplete, there will be minor faults accordingly. The downfall of using water with sentient beings is the forty-first. The story of the downfall of staying in a house prepared for fornication is: The Buddha Bhagavan was staying in Shravasti, in the Jeta Grove of Prince Jeta, in the Anathapindika's Garden. The venerable Upali, knowing the wisdom of the jewel of thought. He put on his lower garment in the morning, took his bowl and Dharma robes, and went to Shravasti for alms. In Shravasti, there was a young incense merchant who had just gotten married and was setting up his stall. He thought, "I want to enjoy happiness with my wife," and generated an improper intention. So he began to pack up his stall. The venerable Upali knew his thoughts and thought, "I will go and make him hopeless," so he first went to the young man's house, sat on the mat, and began to teach the Dharma to the girl. After a while, the young incense merchant came and said to his wife, "Please offer alms to the venerable Upali and then ask him to leave."

The venerable Acharka said: "Good sir, I have completely abandoned my virtuous qualities and come to teach the Dharma. Do you not wish to listen to the Dharma? Sit down and listen to the Dharma." He forcibly made him sit down, and the more he distanced himself from those entanglements, the more he taught the Dharma. The way of practice of those sons of the Shakya is truly shameful! The way of practice of the Brahmins is truly shameful! They cannot even control their own wives, how shameful! They condemn, mock, and insult. Monks, why do you, who are content with little, knowingly sneak into the homes of those who are sexually promiscuous and sit on the seats?" They condemn, mock, and insult. At that time, the monks reported this matter to the Blessed One. Then, the Blessed One, as before, again established the precept: "If a monk knowingly and deliberately sneaks into the home of someone who is sexually promiscuous and sits on a seat, he commits a Patayantika offense." The place was Sravasti. The person was Acharka. The affliction was the entanglement of desire. The offense was knowingly and deliberately sneaking into the home of someone who is sexually promiscuous and sitting on a seat. Furthermore, "monk" refers to Acharka, or anyone else like him. "Knowingly and deliberately" means that he himself knows, or that others have told him. "Sexually promiscuous" means that a woman is sexually promiscuous with a man, or a man is sexually promiscuous with a woman. "Home" refers to the home of a Brahmin or householder. "Sneaking in" means entering secretly. "Seat" refers to the ground. "Sitting down" means placing the buttocks within the span of a step. "Committing a Patayantika offense" means as before. Here, the fundamental Patayantika offense is classified in detail: A monk, not under the influence of fear, nor with his mind set on another place, but seeing that householders (men and women) have no other place to be seen, and that up to the edge of the act there is no different object, and that there is no other person to whom it can be entrusted, and knowingly and manifestly engaging in or approaching sexual intercourse.
