不回答问题,被提问后不阐述本意,别人对别人说,搜集外面的话,令清净的比丘不悦,依靠偏袒,不知罪过不知无罪过。邬波离,如果具备这五种法,则不应采纳答辩比丘的话语。邬波离,如果具备这五种法,则应采纳答辩比丘的话语。哪五种呢?如实回答反驳比丘的提问,不异说提问的意义,不异说其他的外面话语,不令清净的比丘不悦,不依靠偏袒,知罪过知无罪过。邬波离,如果具备这五种法,则应采纳比丘答辩的话语。邬波离,如果反驳和答辩的比丘们想要平息争端,就寻找具备十六法的持律公正人。十六法是什么呢?具戒,最初受具足戒,有惭,有愧,持律,乐于学习,多闻,持闻,积闻,调伏,完全了知增上调伏,经部,精通律的讽诵,而且还要再三地考察他:这位具寿有公正的素质吗?这位具寿以前没有参与过吗?这位具寿擅长处理以前发生的争端吗?这位具寿不是为了钵,不是为了法衣,不是为了少许财物,不是为了欲望而行事吗?不是因为嗔恨、愚痴和恐惧而行事吗?这位具寿不是被贪欲所困扰吗?不是被嗔恨所困扰吗?不是被愚痴所困扰吗?不是违背胜者的教诲吗?这位具寿不会把非理说成是理吗?不会断绝道理吗?这位具寿能用导师所教的法和律来彻底平息争端吗?这位具寿能把具寿从不善之处

Not answering the question, not explaining the meaning after being asked, others speaking to others, collecting outside words, making the pure monks unhappy, relying on partiality, not knowing faults and not knowing faultlessness. Upali, if one possesses these five qualities, then the words of the answering monk should not be accepted. Upali, if one possesses these five qualities, then the words of the answering monk should be accepted. What are the five? Answering the questions of the refuting monk truthfully, not speaking differently about the meaning of the question, not speaking differently about other outside words, not making the pure monks unhappy, not relying on partiality, knowing faults and knowing faultlessness. Upali, if one possesses these five qualities, then the words of the answering monk should be accepted. Upali, if the refuting and answering monks want to pacify the dispute, then seek an impartial Vinaya holder who possesses sixteen qualities. What are the sixteen? Possessing morality, having first taken full ordination, having shame, having regret, holding the precepts, being eager to learn, being widely learned, holding what is heard, accumulating what is heard, taming, fully knowing the higher taming, the Sutra Pitaka, being skilled in reciting the Vinaya, and also examining him again and again: Does this venerable one have the qualities of impartiality? Has this venerable one not participated before? Is this venerable one skilled in handling disputes that have occurred before? Is this venerable one not acting for the sake of a bowl, not for the sake of robes, not for the sake of a small amount of wealth, not for the sake of desire? Is he not acting because of hatred, delusion, and fear? Is this venerable one not afflicted by greed? Is he not afflicted by hatred? Is he not afflicted by delusion? Is he not transgressing the teachings of the Victorious One? Does this venerable one not say that what is unreasonable is reasonable? Does he not cut off reason? Does this venerable one thoroughly pacify disputes with the Dharma and Vinaya taught by the Teacher? Can this venerable one lead the venerable one from unwholesome places?

从而被劝导,他们是否会被安置于善处呢?邬波离,由于争论者和反驳者的比丘们想要平息争端,所以应当寻找具备这十六种法相的调解者和持律者。邬波离,如果调解者和持律者具备五种法相,就不能平息争端。这五种法相是什么呢?就是使争论者和反驳者的比丘进入非法的一方;与争论者和反驳者的比丘争斗、揭短、怀恨、煽动争端;不尊重调解比丘们的经藏之语;对受人爱戴的比丘进行诽谤;不精通争端的开始、中间和结尾。邬波离,如果调解者和持律者具备这五种法相,就能平息争端。这五种法相是什么呢?就是使争论者和反驳者的比丘进入正法的一方;不与争论者和反驳者的比丘争斗、揭短、怀恨、煽动争端;尊重调解比丘们的经藏之义;不对受人爱戴的比丘进行诽谤;精通争端的开始、中间和结尾。邬波离,如果那位调解者和持律者想要善加处理争端,就应当在十六个方面对自己和他人进行彻底的考察,然后才能处理争端。应当用八个方面来彻底考察自己,用八个方面来彻底考察他人。考察自己的八个方面是什么呢?我是否精通争端的开始、中间和结尾?我是否从一开始就没有介入这场争端?我是否偏袒争论者和反驳者的比丘?我是否听取争论者和反驳者的比丘的意见?我是否能够调解争论者和反驳者的比丘的过失?我是否能够按照正法教导各自的立场?我是否能够像调伏争端和如来所教导的那样平息争端?我是否能够将争论者和反驳者的比丘从不善之处劝导出来,并将他们安置于善处呢?这就是用八个方面来彻底考察自己。

And are they persuaded and placed in a state of virtue? Upali, because the monks who are disputants and respondents want to pacify the dispute, a mediator and Vinaya holder who possesses these sixteen qualities should be sought. Upali, if a mediator and Vinaya holder possesses five qualities, he will not be able to pacify the dispute. What are the five? It is to lead the monks who are disputants and respondents into the side of what is not Dharma; to fight with the monks who are disputants and respondents, to expose shortcomings, to harbor resentment, to incite disputes; to not respect the words of the Sutra Pitaka of the mediating monks; to slander the beloved monks; and to not be skilled in the beginning, middle, and end of the dispute. Upali, if a mediator and Vinaya holder possesses these five qualities, he will be able to pacify the dispute. What are the five? It is to lead the monks who are disputants and respondents into the side of the Dharma; not to fight with the monks who are disputants and respondents, to expose shortcomings, to harbor resentment, to incite disputes; to respect the meaning of the Sutra Pitaka of the mediating monks; not to slander the beloved monks; and to be skilled in the beginning, middle, and end of the dispute. Upali, if that mediator and Vinaya holder wants to handle the dispute well, he should thoroughly examine himself and others in sixteen aspects, and then he can handle the dispute. One should thoroughly examine oneself in eight aspects, and thoroughly examine others in eight aspects. What are the eight aspects of examining oneself? Am I skilled in the beginning, middle, and end of the dispute? Have I not been involved in this dispute from the beginning? Do I favor the monks who are disputants and respondents? Do I listen to the opinions of the monks who are disputants and respondents? Am I able to mediate the faults of the monks who are disputants and respondents? Am I able to teach each position according to the Dharma? Am I able to pacify the dispute in the way that disputes are subdued and as taught by the Tathagata? Am I able to persuade the monks who are disputants and respondents from the state of non-virtue and place them in a state of virtue? This is to thoroughly examine oneself in eight aspects.
