Although the venerable Upananda has fallen into transgression, he does not repent according to the Dharma. To this, monks who seek meaning, monks who seek benefit, monks who seek happiness, monks who seek to touch happiness, monks who seek accomplishment and happiness, rebuke him for this matter, but the monks turn a deaf ear to the admonition. If the time of the Sangha has come, and it is permissible, may the Sangha permit it. The Sangha has listed the venerable Upananda as one who turns a deaf ear to the admonition. This is a request. When the Sangha admonishes a Bhikshu with exhortation, and (the Bhikshu) pretends to be deaf and dumb, being counted among those who pretend to be deaf and dumb, then the Bhikshus will pretend to be deaf and dumb, and then (accuse) saying, "Why do a few Bhikshus pretend to be deaf and dumb?" They will scold, mock, and speak ill of each other. At that time, the Bhikshus reported this matter to the Blessed One. After that, the Blessed One, regarding this occurrence and this basis of discussion, and At this time, the Bhikshu gathers the Sangha, etc., all as mentioned before. The Buddhas, the Blessed Ones, knowingly commit offenses, etc., also as mentioned before. The Buddha, the Blessed One, rebuked the Bhikshu, asking, "Bhikshu, is it true that you pretend to be deaf and dumb?" The Bhikshu replied, "Venerable One, it is true." The Buddha, the Blessed One, rebuked, saying, "This does not conform to the behavior of a Shramana, does not follow, is not lawful, is not in accordance with the rules, a renunciate should not act in this way." After that, the Blessed One rebuked in various ways, and then said to the Bhikshus, "Bhiksus, therefore, in order to be able to correctly see the ten benefits, the foundation of learning should be established for the Shravakas." etc., all as mentioned before. My Shravakas should recite the foundation of learning of the Vinaya in this way: Pretending to be deaf and dumb, one commits a Patayantika offense. Pretending to be deaf and dumb means expressing language, words, names, sounds, statements, definite words, the path of words, the sound of words, the actions of language, and the expression of language with the intention of pretending to be deaf and dumb. Committing a Patayantika offense means burning, cooking, and causing beings to fall into hell, animals, hungry ghosts, evil paths, evil destinies, and wrong views. Furthermore, as long as there is no confession and individual confession, this Patayantika offense will hinder virtuous dharmas, therefore one will commit a Patayantika offense.
